2016年立法會選舉及2017年行政長官選舉討論方案


The Hong Kong Democratic Foundation sets out proposals for discussion for the 2016 LegCo elections as part of the progress towards the achievement of equal and universal suffrage by 2020 whereby all LegCo seats are returned by direct election and for the implementation of the election of the Chief Executive by equal and universal suffrage in 2017, with reference to articles 26, 45 and 68 of the Basic Law1.

2016 LegCo Elections

FUNCTIONAL CONSTITUENCIES

For those Functional Constituencies (FC) in which voting includes corporate voters, these are to be replaced by individual votes from staff and management members of companies, organizations or institutions that are the constituent members of each FC. This change would apply to the following FCs:

Agriculture and Fisheries (159 corporate voters)
Catering FC (578 corporate voters)
Commercial (First) FC (1,040 corporate voters)
Commercial (Second) FC (759 corporate voters)
Finance FC (140 corporate voters)
Financial Services FC (580 corporate voters)
Import and Export FC (868 corporate)
Industrial (First) FC (715 corporate voters)
Industrial (Second) FC (790 corporate voters)
Information Technology FC (357 corporate voters)
Insurance FC (144 corporate voters)
Labour FC (596 corporate voters)
Real Estate and Construction FC (448 corporate voters)
Sports, Performing Arts, Culture and Publication FC (2,052 corporate voters)
Textiles and Garment FC (3,581 corporate voters)
Tourism FC (1,261 corporate voters)
Transport FC (178 corporate voters)
Wholesale and Retail FC (1,838 corporate voters)

A formal process should take place in 2015 to review new applications from bodies or groups wishing to be included as constituent members of any FC.

DIRECTLY ELECTED CONSTITUENCIES

The 5 District Council FC seats requiring candidates to be District Councilors should have that qualification removed and the 5 seats be reconstituted as a territory-wide geographical constituency (TWGC).

The additional 1 seat added to each geographical constituency (GC) for the 2012 LegCo election should be transferred to the TWGC, so that this constituency would comprise 10 seats.

A further 10 new LegCo seats would be added to the TWGC.

Candidates for the TWGC would be required to secure a minimum of 500 nominations, 100 nominations from registered voters in each of the 5 GCs.

2016 LEGISLATIVE COUNCIL COMPOSITION

Total 80 seats:
30 seats from 5 Geographical Constituencies
30 seats from Functional Constituencies
20 seats from the Territory-wide Geographical Constituency

NOMINATING COMMITTEE

Formation

Alternative 1
By direct election of registered voters electing 3 members in each of the 400 District Council sub-constituencies by the Single Transferrable Voting system.

Alternative 2
Nomination committee based on 2012 CE election committee with following changes:

  • All corporate votes replaced by individual votes from staff and management of companies in each sector

  • All elected district councilors to join the nominating committee

Alternative 3
Nominating committee formed through random selection of a statistically representative sample from all registered voters.

Nominating and Election Process

Any Chinese national who is a registered GC voter can become a potential candidate with nominations from at least 1/8 of the members of the Nominating Committee (NC) or with at least 100,000 nominations from registered GC voters.

All candidates once elected to be nominated by the NC have to affirm to abide by the Oath of the CE Office.

After the closing date for submission of requests for nominations by candidates, the NC (e.g. jointly signed by 100 NC members) has right to evaluate the nominations for compliance with the rules after his or her declaration of candidacy and make complaint to the Electoral Affairs Commission to start a judicial process of removing the candidate.

The final list of qualified nominated candidates will stand for election by universal suffrage, using the majority run-off system. A second round of CE elections will be held if no candidate received more than 50% of the votes and the two candidates with the highest vote count will proceed to the second round.

1 Article 26: Permanent residents of the Hong Kong Special Administrative Region shall have the right to vote and the right to stand for election in accordance with law.

Article 45: The Chief Executive of the Hong Kong Special Administrative Region shall be selected by election or through consultations held locally and be appointed by the Central People's Government. The method for selecting the Chief Executive shall be specified in the light of the actual situation in the Hong Kong Special Administrative Region and in accordance with the principle of gradual and orderly progress. The ultimate aim is the selection of the Chief Executive by universal suffrage upon nomination by a broadly representative nominating committee in accordance with democratic procedures. The specific method for selecting the Chief Executive is prescribed in Annex I "Method for the Selection of the Chief Executive of the Hong Kong Special Administrative Region".

Article 68: The Legislative Council of the Hong Kong Special Administrative Region shall be constituted by election. The method for forming the Legislative Council shall be specified in the light of the actual situation in the Hong Kong Special Administrative Region and in accordance with the principle of gradual and orderly progress. The ultimate aim is the election of all the members of the Legislative Council by universal suffrage. The specific method for forming the Legislative Council and its procedures for voting on bills and motions are prescribed in Annex II: "Method for the Formation of the Legislative Council of the Hong Kong Special Administrative Region and Its Voting Procedures".

香港民主促進會 根據「基本法」第二十六, 四十五 及六十八條1, 就2016年立法會選舉、及2017年行政長官選舉提出建議。建議內容是為在2017年實施普及和平等的行政長官選舉和朝著最終在2020年達至全部立法會議員由普選產生的目標、可以在2016年立法會選舉實施時取得實質進展、提出一些符合基本法規定的討論方案。

2016年立法會選舉

功能界別

建議對於有些包括有團體選民的「功能界別」、代表公司投票的選民將會由每公司的工作人員和管理人員代替;組織或機構的成員的功能界別的選票將由個人選票取代。這改變將適用於下列的「功能界别」:

漁農界(159 團體選民)
飲食界功能界別(578 團體選民)
商界(第一)功能界別(1,040 團體選民)
商界(第二)功能界別(759 團體選民)
金融界(140 團體選民)
金融服務界功能界別(580 團體選民)
進出口界功能界別(868 團體選民)

在2015年,選舉管理委員會是有需要實施一個正式和公開的程序,  去處理任何希望成為功能界別組成機構或團體新增成員的申請。

直選選區

建議取消要求五個「區議會功能界別」議席候選人必需要是區議員的條件、並改組成立一個「全港性選區」。2012年立法會選舉中在每個「地方選區」增加的一個議席,建議轉移到「全港性選區」,讓這個新組成的選區有10個席位。另外更新增10個「全港性選區」的立法會議席、使「全港性選區」增至共 20席。

「全港性選區」的候選人需要取得不少於500個提名,並且在5個 「地方選區」中各取得不少於100個提名。

2017年行政長官選舉

提名委員會

組成建議

方案1:
在400個區議會選區中的每一個選區,由合資格的地區選民,通過單一可轉移投票制,直接從每一區選出3名成員。

方案2:
提名委員會根據2012年行政長官選舉委員會的組成方案、但建議以下改變:

  • 由公司各部門人員和管理人員的個人票取代團體票,

  • 所有獲選區議員加入選舉委員會。

方案3
由選舉管理委員會(選管會)通過隨機抽出由選民組成的提名委員會成員。

這隨機抽出的選民需在統計學上符合具有廣泛代表性的要求。

行政長官提名和選舉過程

建議任何一個在地方選區已登記成為選民的中國公民,得到提名委員會至少八分之一員提名或至少100,000個所有地區登記選民提名,便可以成為行政長官候選人的人選。

人選在成為「正式候選人」之前,需要正式進行確認遵守行政長官職責的宣誓。

提名委員會成員(例如由100人聯名),有權就候選人提名的截止日期後對「正式候選人」在公開宣報參選後是否有遵守或違反誓言作出評估和向「選管會」提出違反誓言的投訴,並展開除名的司法程序。

最終合資格「正式候選人」參選的名單,將採用多數表決制度,由一人一票普選產生。如果沒有候選人在第一輪獲得超過50%的選票,第二輪行政長官選舉將由得票最高的兩名候選人,進行第二輪投票。

1 第二十六條
香港特別行政區永久性居民依法享有選舉權和被選舉權。

第四十五條
香港特別行政區行政長官在當地通過選舉或協商產生,由中央人民政府任命。行政長官的產生辦法根據香港特別行政區的實際情況和循序漸進的原則而規定,最終達至由一個有廣泛代表性的提名委員會按民主程序提名後普選產生的目標。行政長官產生的具體辦法由附件一《香港特別行政區行政長官的產生辦法》規定。

第六十八條
香港特別行政區立法會由選舉產生。立法會的產生辦法根據香港特別行政區的實際情況和循序漸進的原則而規定,最終達至全部議員由普選產生的目標。立法會產生的具體辦法和法案、議案的表決程序由附件二 《香港特別行政區立法會的產生辦法和表決程序》規定。
